INFORMATION ON THE PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH REGULATION (EU) no. 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 27 APRIL 2016
Pursuant to and for the purposes of Article 13 and Article 14 of Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free circulation of such Data (General Data Protection Regulation, hereinafter also “Regulation” or “GDPR”) and which repeals Directive 95/46/EC, we inform you that the Personal Data voluntarily made available by you to Università Telematica Pegaso (hereinafter also “University”) will be processed in compliance with the current legislation on the protection of Personal Data and, in any case, with the principles of confidentiality that inspire the University’s activity.

1. Categories of Personal Data processed

Università Telematica Pegaso will process the following Personal Data provided by the Interested Party:

  • Dati anagrafici (quali: nome, cognome, data e luogo di nascita, sesso), password, e-mail, recapito telefonico, indirizzo e nazionalità, titoli di studio (di seguito, anche, “Dati Personali” o “Dati”).
  • Dati particolari relativi all’eventuale percentuale di invalidità riconosciuta dall’Ente accertatore e altri dati relativi allo stato di salute.

2. Purpose of the processing.

The Personal Data you make available to Università Telematica Pegaso may be used for the following purposes:

  1. To allow and manage your enrollment at the University;
  2. To allow you to use the specific, necessary, indispensable and instrumental services for training and follow your study path and university life remotely, as well as to carry out the activities reserved for you by virtue of your enrollment at the University, such as, by way of example and not limited to, access to the teaching platform, e-learning technological tools (also based on generative AI applications), the Apps, the interaction service with tutors and between students, the learning monitoring service, the reporting service on the training activities carried out by students, the student secretarial service and administrative and accounting orientation (also based on generative AI applications), social networking tools, the video conference and chat service;
  3. For administrative and accounting purposes (also through generative AI applications) and for the fulfillment of obligations under current legislation;
  4. For marketing activities, following your possible and specific consent, such as the sending of informative and promotional communications (including our newsletter), advertising material and/or educational offers, by any means, including, by way of example and not limited to, post, Internet, telephone, e-mail, MMS, SMS by the University or by educational partners of Università Telematica Pegaso;
  5. For the search for professional profiles following recruiting actions carried out directly by companies or by companies appointed by them;
  6. For the dissemination of photos and videos for promotional purposes of testimony on the teaching methods of the University.
  7. We remind you that, with reference to the purposes highlighted in points a), b) and c), the provision of your Personal Data is mandatory. Any refusal and/or provision of inaccurate and/or incomplete information would prevent:
  8. With reference to the purpose referred to in point a): your membership/registration at the University pursuant to art. 6 letter b) of EU Regulation 679/2016
  9. With reference to the purpose referred to in point b): to use the services, as well as the
  10. performance of the activities reserved for you by virtue of your registration at the University pursuant to art. 6 letter b) of EU Regulation 679/2016;
  11. With reference to the purpose referred to in point c): the performance of administrative-accounting activities and the correct fulfillment of regulatory obligations pursuant to art. 6 letter c) of EU Regulation 679/2016.
  12. With reference to the additional purposes highlighted in points d), e) and f), the provision of your Personal Data and consent to their processing for the aforementioned purposes is optional and subject to explicit consent.

3. Methods of processing

The processing of your Personal Data will be carried out using suitable paper, electronic and/or telematic tools, with logics strictly related to the purposes indicated above and, in any case, in such a way as to guarantee the security and confidentiality of the Data itself. Your Personal Data are processed with the aid of IT tools in a lawful and correct manner for the fulfillment of the purposes indicated above and are protected with suitable security measures that guarantee their confidentiality, integrity, accuracy, availability and updating.

They are stored for a period of time not exceeding that necessary for the purposes for which they were collected or subsequently processed.

In the event that the user (i) logs in or registers on the University platform using the login credentials of a social network (for example Facebook or Twitter, hereinafter “Social Network”) or (ii) associates his/her account with an account of the same user on a Social Network, he/she may receive from such Social Network Data relating to the user, in accordance with the conditions of use and the provisions of the privacy policy of the Social Network itself. Università Telematica Pegaso may add such information to the User Data already collected through its services.

If the user chooses to share information with such Social Networks, he/she receives the Data from the latter in accordance with the consent options provided by the user. Any Personal Data communicated by the Social Network will be subject to the terms and conditions of use of the Social Network. With regard to generative AI applications, these operate according to methods of anonymization of personal data.

4. Recipients or Categories of Recipients of Personal Data

Your Personal Data may be disclosed to members, members of the board of directors or other administrative body, the Data Protection Officer, and, in any case, the Managers designated by the University and the Persons in Charge of the processing of Personal Data appointed by Università Telematica Pegaso in the exercise of their functions.

Your Personal Data may be disclosed to any persons who provide the University with services or performances instrumental to the purposes indicated in the previous paragraph 2 such as, by way of example and not limited to, parent companies, subsidiaries, affiliates and/or associates. Your Personal Data may also be disclosed to suppliers, contractors, subcontractors, banks and/or insurance companies or other persons and/or entities who provide on behalf of Università Telematica Pegaso:

  • The management and/or maintenance of the websites and electronic and/or telematic tools used by the University;
  • To manage membership/registration at the University;
  • To send information and promotional communications, advertising material and/or educational offers.

Finally, your Personal Data may be transferred to companies or firms that provide the recruiting service on behalf of companies for Università Telematica Pegaso.

Your Personal Data, strictly necessary for the provision of educational services, may be transferred abroad, in accordance with the provisions of current legislation, including to countries outside the European Union, in line with the institutional purposes pursued by the University. The transfer to non-EU countries, in addition to cases in which this is guaranteed by adequacy decisions of the European Commission, is carried out in such a way as to provide appropriate and suitable guarantees pursuant to Articles 46 or 47 or 49 of the Regulation.

5. Duration of processing and criteria used for the conservation of Personal Data

5.1. Duration

For the purposes referred to in letters a), b) and c) of the previous paragraph 2 “Purpose of Processing” of this information notice, your Personal Data will be processed only for the time necessary.

For the purposes referred to in letters d), e) and f) of paragraph 2 “Purpose of Processing” of this information notice, your Personal Data will be processed until the possible revocation of consent by the Interested Party.

5.2. Conservation

The Data will be stored according to the following criteria:

  • The Data processed for membership/registration at the University referred to in letters a), b) and c) of paragraph 2 “Purpose of Processing” of this information notice, will be stored for the entire duration of your registration and for a period of 10 years following the termination of the relationship, unless the need for further storage arises, to allow Università Telematica Pegaso to defend its rights;
  • The Data processed for the purposes referred to in letters d), e) and f) of paragraph 2 “Purpose of Processing” of this information notice, will be stored for a maximum period of 24 months.

6. Rights of the interested party

We inform you that at any time, in relation to your Data, you may exercise the rights provided for within the limits and under the conditions set out in Articles 7 and 15-22 of the Regulation.

  • To exercise these rights, described below, please contact the Data Controller through the Privacy Office at the email address privacy@unipegaso.it. This request will be given an appropriate response according to the timeframes set out in the GDPR. In detail, the Interested Party has the right to:
  • Revoke the consent previously given, without prejudice to the lawfulness of the processing based on the consent before the revocation;
  • Ask the Data Controller for access, rectification or erasure (so-called “right to be forgotten”) of the Personal Data or the limitation of the processing of Personal Data concerning him or her or to oppose their processing;
  • Obtain data portability;
  • Submit a complaint to the Data Protection Authority if you believe your rights have been violated.

7. Data Controller, Managers and Data Protection Officer

The Data Controller of your Data is the Pegaso Telematic University, with registered office in Centro Direzionale Isola F2 CAP 80132 Naples, in the person of the Legal Representative pro- tempore.

Any request relating to your personal data processed by the University may be sent to the registered office of the University, or by writing to the email address privacy@unipegaso.it.

The updated list of the subjects appointed as Data Processors pursuant to Article 28 of the GDPR is available at the University and can be accessed through a specific request formulated using the methods indicated above.

The Pegaso Telematic University therefore invites Users who wish to know the methods of processing of Personal Data collected by the University to periodically visit this page.

The Data Controller is Pegaso Telematic University

As indicated in the information provided pursuant to Regulation (EU) no. 2016/679 of the European Parliament and of the Council of 27 April 2016, you are aware that the performance of the activities relating to the processing of Personal Data referred to in points a), b) and c) indicated in paragraph 2 of the aforementioned information does not require consent to processing.

However, consent is optional for the processing of Personal Data referred to in points d), e) and f) indicated in paragraph 2 of the aforementioned information.
